CONDITIONS

PARTICIPATION

1.          This competition (ÒCompetitionÓ) is conducted by Mars Australia Pty Ltd, ABN 48 008 454 313, trading as Mars Chocolate Australia, of Ring Road, Wendouree VIC 3355 (ÒPromoterÓ).

2.          Entry to the Competition constitutes acceptance of these conditions.

3.          The Competition is only open to Eligible Entrants. An "Eligible Entrant" is an individual who: (i) is a resident of Australia aged 13 years, or older, as at the time of entry; and (ii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Competition; and (iii) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee. An Eligible Entrant who is under 18 years of age, must obtain the permission of a parent or guardian to enter.

4.          Competition entry opens at 00:00 hrs on 17/8/11 and closes at 24:00 hrs on 13/9/11 ("Entry Period"). All times and dates are times and dates in Sydney which may be AEST or AEDT depending on the date. Where times are stated using the 24 hour clock, 00:00 hrs is the start of a day and 24:00 hrs is the end of a day.

ENTRY

5.          To enter, an Eligible Entrant must, during the Entry Period, first make a Qualifying Purchase from a Caltex All Stars store anywhere in Australia.

6.          A Qualifying Purchase is the purchase of either:

(i)         two of the following confectionery products  (2 of the same, or in any combination and in one or two transactions):

(a)        MARSñ 72g

(b)        SNICKERSñ 72g

(c)        SNICKERSñ Xtreme 72g

(d)        TWIXñ 72g

(e)        BOUNTYñ 63g

(f)         MALTESERSñ 65g; or

(ii)        one of the following confectionery products:

(a)        M&MÕSñ Milk 200g

(b)        M&MÕSñ Peanut 200g

(c)        M&MÕSñ Crispy 160g

(d)        MALTESERSñ 155g

(e)        PODSñ MARSñ 176g

(f)         PODSñ Mint Slice 176g

7.          Subject to the other conditions, an Eligible Entrant may enter the Competition once for every Qualifying Purchase that they make during the Entry Period.

8.          Entry can only be made by SMS. Each SMS will cost 55 cents (including GST) to send, as the SMS service is a premium service (SMS Provider Prime Focus. Info 1800 818 957). To submit an entry, an entrant must send to 1999 6455 an SMS message comprising in the following order with a space between each item: (a) the last 5 digits of the bar code printed on the product comprising the Qualifying Purchase that is being used to enter (if that Qualifying Purchase comprises two products, include only the last 5 digits of the bar code printed on ONE of those two products); (b) the entrant's first name; (c) the entrant's last name; and (d) the entrant's post code; The entrant must use a mobile phone and service with the ability to send SMS messages to premium numbers. Each entry must be sent in a separate SMS.

9.          All entrants must ensure that their entries are received by the Promoter during the Entry Period. The Promoter takes no responsibility for any late or misdirected entry or for any delays or failures in any telecommunications service or equipment.

10.       For each and every Qualifying Purchase that an Eligible Entrant uses to submit an entry, he/she MUST retain the Caltex All Stars store receipt(s) (original or photocopy) that was issued / were issued when that Qualifying Purchase was made.

11.       All entries to the Competition may be subject to verification by the Promoter. The Promoter will reimburse an entrant for any reasonable costs incurred in complying with this condition.

(i)         An entrant MUST, within 7 days of being asked, deliver to the Promoter (by a means determined by the Promoter) all of the items which condition 10 requires the entrant to retain and which are requested by the Promoter. The Promoter may elect not to return those items.

(ii)        An entrant MUST also deliver to the Promoter (by a means determined by the Promoter) copies of any other documents the Promoter may request establishing eligibility to enter or win, including evidence of age, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an entrant must deliver requested copies within 7 days of being asked to do so. At the Promoter's request, an entrant MUST also, within 7 days of being asked, allow the Promoter to inspect and copy the original of any such document.

12.       The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: (i) fails to establish their entitlement to enter the Competition to the Promoter's reasonable satisfaction; or (ii) fails to produce items as required by condition 10 or produces items that, in the Promoter's reasonable opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (iii) in the Promoter's reasonable opinion, tampers with the entry process or benefits from such tampering; or (iv) in the Promoter's reasonable opinion, submits an entry which is not in accordance with these conditions.

ENTRIES

13.       On any one day: (i) an Eligible Entrant may submit no more than 6 SMS entries; and (ii) no more than 6 SMS entries will be accepted from any one mobile phone number.

14.       The Promoter will only accept SMS entries submitted manually using a mobile phone. The Promoter may reject SMS entries if it reasonably forms the opinion that they have been entered using other entry means, including the internet or automated means.

15.       An SMS in reply may be sent to the mobile phone sending each entry. The reply SMS will state that the entry is rejected if the daily limit has been exceeded. If the entrant resubmits a rejected entry, the entrant will incur another SMS charge. The time to receive a reply may vary and receipt is subject to network coverage and availability, memory inside the sending mobile phone not being full and any other technical problems.

16.       For winning SMS entries, the person entitled to the relevant prize is the person who was entitled to use the mobile phone at the time the winning entry was sent and who can produce the items required to be produced by condition 10. If more than one person claims to meet these requirements and claims the prize, the Promoter will have the sole discretion to determine which of those persons is the winning entrant.

INSTANT WIN BY TIME AND PRIZES

17.       Instant win entry opens at 00:00 hrs on 17/8/11 and closes at 24:00 hrs on 13/9/11 (the "Instant Win Period"). Entries received outside that period will not be eligible to win an Instant Win Prize.

18.       There will be 672 instant win entry periods (each an "Instant Win Entry Period"), one for each hour during the Instant Win Period. Each entry received during the Instant Win Period will be allocated to the Instant Win Entry Period during which it was received by the Promoter. An entry received exactly on the start of Instant Win Entry Period will be allocated to the Instant Win Entry Period that is just commencing.

19.       One instant win prize ("Instant Win Prize") is available to be won instantly during each of the 672 Instant Win Entry Periods. Each Instant Win Prize is a M&MÕS Confectionery dispenser (either a ÒHot RodsÓ dispenser or a ÒGolfÓ dispenser), valued at $20.

20.       The total number of Instant Win Prizes available to be won is 672.

21.       One time during each of the 672 Instant Win Entry Periods (ÒTimeÓ) will be randomly selected. One Instant Win Prize will be randomly allocated to each Time. For each Time:

(i)         The Eligible Entrant who submits the first valid entry that is received by the Promoter at or after the Time will win the Instant Win Prize allocated to that Time.

(ii)        A valid entry will be disregarded for the purposes of allocating the Prize for the Time if that entry has previously been allocated a Prize for another Time.

22.       If, at the end of the Instant Win Period, any Instant Win Prizes have not been won, they will be awarded in a second chance draw which will be drawn from all entries except entries that have already won a prize and will commence at 12 noon on 14/9/11 at 403/62 Beach Street, Port Melbourne VIC 3207.

23.       The total value of all prizes is $13,440.

24.       Each prize is valued as at 6/6/11. The Promoter takes no responsibility for any variations in value of a prize.

25.       If a prize (or part of a prize) is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Competition. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if a prize (or part of a prize) is unavailable for any reason.

26.       A right to receive a prize is not transferable or exchangeable and cannot be taken as a monetary payment

WINNERS

27.       Each winner, whenever determined, will be notified in writing sent by SMS to the mobile phone number from which the entry was sent. The notification will include instructions as to how the winner is to claim the prize and establish his/her entitlement to it.

28.       Subject, where relevant, to any directions given under the legislation regulating the Competition, if any prize is not claimed by 21/12/11, the prize will be awarded to another Eligible Entrant in a redraw commencing at 12 noon on 5/1/12 at 403/62 Beach Street, Port Melbourne VIC 3207.

29.       In order to be entitled to any prize, each winner must, if requested by the Promoter, agree to and sign and return an eligibility form confirming their compliance with the Conditions and eligibility to accept the Prize. The winner will forfeit his/her Prize if he/she fails to ensure that all documents relating to the Prize are signed and returned in accordance with this condition, as and when required by the Promoter.

GENERAL

30.       If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way by a cause outside the reasonable control of the Promoter (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, tampering, computer bugs or viruses or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.

31.       The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication including any SMS communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition.

32.       All of the PromoterÕs decisions are final and no correspondence will be entered into.

33.       To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Competition or prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions is intended to exclude, restrict or modify an entrantÕs rights under the Competition and Consumer Act 2010.

34.       If any provision of these conditions is unenforceable for any reason, it will be severed and the remaining provisions will remain in full force and effect.

35.       Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Competition and  announce its winners and, if an entrant consents, may be used to market its products to the entrant. The personal information of each winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers, and to regulatory authorities. Persons may contact the Promoter by post at the address stated in condition 1 to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize.
